


• We know the history of Lo Iacono, Melfi and the City Council, for months
ignoring residents and business owners who have packed City Council
meetings and participated in rallies and demonstrations to voice their outrage
and opposition to the transfer of Fire Department-based EMS to HUMC. The
City’s Response: Ignore the people. EMS transfer will happen.
• A Coalition of Residents, Businesses and Unions collected twice the
number of signatures required on a petition calling on City officials to place the
EMS issue on the November ballot as a referendum so we can vote on who
provides EMS. The City’s Response: Ignore the people – again. Sorry folks,
your petition doesn’t count. Legal loophole. EMS transfer will happen.
• On Fri., Sept. 12, at approx. 2:30 p.m., Bergen County Superior Court
Judge Menelaos W. Toskos granted Local 2081 Professional Firefighters &
EMTs a temporary injunction that, 1) declared paragraph 13 – transfer of EMS
to HUMC – of the Developer’s Agreement between the City and HUMC
ILLEGAL, 2) found that City officials violated a State law by giving away the
EMS contract without putting it out for competitive bidding, and 3) restrained
the City from transferring EMS to HUMC on Sept. 15. The City’s Response:
Ignore the Courts. Judge Toskos, haven’t you seen what we’ve been doing to
Hackensack residents and businesses? Ignoring them. Even with your
temporary restraining order, EMS transfer will happen. By the way Judge, we
out-smarted you just in case you ruled against us. Here’s how:
• On Tues., Sept. 9, three days before the court hearing, Lo Iacono sent a
memo to Melfi, the City Council and the City’s Acting CFO, stating: “While I am
confident the City will prevail in court, I also want to ensure uninterrupted EMS
service for the City. Therefore, in preparation for the unlikely possibility of the
court’s ruling in a manner which may adversely affect how EMS service is
provided to the City on September 15 and thereafter… I am invoking my
emergency powers and will implement the provisions of the… Developers
Agreement… and implement agreement with HUMC on September 15. The
emergency agreement will be in effect only if necessary and only until the
provisions of any potential court ruling can be adhered to.”
• Translation: Lo Iacono back-doored the Judge and defied the temporary
restraining order. Lo Iacono fabricated an emergency situation in the EMS
system earlier in the week, ahead of the Judge’s ruling – just in case the
Judge ruled against the City (which he did). By doing this, Lo Iacono, Melfi and
the City Council could transfer EMS to HUMC under an emergency contract. In
